Terms and Conditions for the Attribution and Use of Coins

This Terms and Conditions for the Attribution and Use of Coins (« Coin Terms ») and the Augmented Discovery General Conditions of Use (“Term“), together provide the conditions under which you (« User » or « You ») can use the Augmented Discovery Mobile Application (“App”) and related products and services provided by Augmented Discovery Inc. (“We”, “Us”) and its affiliated merchants.

Please read these Coin Terms carefully. They provide the conditions pursuing to which you can acquire, use or redeem any virtual coin, token or other in-game currency available through or otherwise in relation to the App (“Coins“). By downloading the App and by activating a user account located on the « My Account » section of the App (« Account »), You agree to be bound by the Term and these Coin Terms. These Coin Terms will prevail over the Term, in case of conflict.

  1. What are Coins?

Coins are branded “UnderCoin” for use within the Montreal Underground City, and “City Coin” for use outside the immediate vicinity of the Montreal Metro network.

Coins are not a currency and have no cash value. Coins can only be acquired or used through the App. Coins are an App’s feature associated to Your Account. Therefore, you can not transfer or exchange Coins with other App users. Augmented Discovery Inc. is the only party permitted to issue, attribute and redeem Coins.

Coins can only be used to redeem orders through the App’s Coin Store section (“Coin Store”), in exchange for offers from Us or from our affiliated merchants. Further to your order to redeem Coins for a chosen offer, We will process Your redeem order and We will sent you a confirmation of Coins redeem to the email to the address associated with Your Account. You are informed when Coins are attributed to You and/or redeemed from Your Account at the moment of the attribution and/or redemption.

 

  1. When do these Coin Terms apply?

These Coin Terms apply to Your acquisition or use of Coins. These Coin Terms also apply whenever We attribute Coins to You after You have participated to a competition, a survey or a marketing campaign or because you have won a competition.

Coins can only be acquired or used within the App pursuant with these Coin Terms. You acknowledge that certain additional in-App functionalities may only be accessible by You in exchange for Coins.

These Coin Terms are not geographically limited and will apply, whichever your country of residence

  1. How can I acquire Coins?

You can acquire Coins through an action within the App. Different user actions are worth different amounts of Coins, and may qualify You to participate to temporary offers or for Coin purchases opportunities.

In order to acquire coins, You must open an Account and be loggedin within the App. You will be prompted to do so if You have not already done so.

  1. Can I transfer Coins between the App and website accounts?

YouCoins attributed to You within the App are valid only within the App, and can not be transferred, to any other user account, including another account You register within the App or the Augmented Discovery website.

  1. How do I spend my Coins?

You can use Your Coins to redeem orders for additional features, items, offers or benefits (“Coin Store Items”) from the Coin Store, or with merchants affiliated to us which are located in designated areas within the Montreal Underground City and beyond the vicinity of the Montreal Metro network. When You use Coins to acquire Coin Store Items, the relevant amount of Coins will automatically be deducted from Your Account.

We can at any time, without notifying You, vary the scope, variety and type of Coin Store Items. We have no obligation to make, or continue to make, any specific Coin Store Item available. We may also restrict or vary the type of Coin Store Items available to You based on Your country of residence.

  1. What am I not allowed to do with my Coins?

After acquiring or using Coins, You agree not to transfer or attempt to transfer Coins from Your Account to any other account . Users are strictly prohibited to register, have or use multiple accounts to hold and use Coins, or to use or attempt to use Coins in any manner that is contrary to the general purpose of the app or these Coin Terms. Users are alsostrictly prohibited to sell or attempt to see a useraccount or any Coins, to any person.

We may from time to time limit the use of Coins, including applying limits to the number of Coins allocated to Your account at any time, and/or the number of Coins redeemable within a given time period.

7.What happens to my Coins if my account is suspended or terminated?

We reserve the right to suspend or terminate Your account if:

o   We or our designated payment processor are unable to verify or authenticate any information You provide in connection with the acquisition or use of the relevant Coins;

o   We are notified of or reasonably suspect any cheating, fraudulent, abusive or other unlawful activity whatsoever in relation to Your account or Coins balance; or

o   You are otherwise in breach of these Coin Terms, the terms of the third party payment service provider or any other Terms.

 

We can also suspend or terminate Your Account if we have reasonable grounds to suspect that You are engaging in unauthorized, unlawful, fraudulent or other improper activity.

 

If Your Account has been suspended for the first time, We may at our complete discretion void or remove all of the Coins in Your account, and allow reactivation of your Account. If Your Account has been suspended for a second time, We may suspend or terminate Your account and void or remove Your Coins, and prevent you from attempting to register a new Account.

You are not entitled to any reimbursement, refund or any other compensation, except at our sole discretion, when your Account is suspended or terminated.

8.What do I do if I have not received my Coins?

It is possible that You have successfully completed the necessary action(s) for Your Coins, but You may not have received them. Please remember that during busy periods, there may be a short delay before Your Coins are assigned to Your account.

If You are still having issues receiving Your Coins and You have not received them after 48 business hours, please let us know by contacting customer support at: [email protected]

 

9.What is Augmented Discovery not responsible for?

We are not responsible for the following types of loss or damage which may arise from Your use of the App:

o    Damage or loss not caused by our breach of the Coin Terms;

  • Loss or damage if the Coins are not provided to You, or if Your access to Coins is interrupted or suspended , and caused by an event beyond Our control, which we and You could not anticipate nor expect to happen when You started using the App;
    • Any loss or damage You may directly or indirectly suffer or claim to suffer, if the App, Your Account or Coins associated to your Account are interrupted or suspended, or if We do not comply with the Coin Terms because of events beyond our control, such as an act of God, accident, fire, lockout, strike or other official or unofficial labour dispute, civil commotion or other act or event beyond our reasonable control.

 

You agree that We will NOT be liable to You in any way whenever We use our reasonable discretion to suspend or terminate Your Account, or void or remove any Coins associated to Your Account.
